These are the Terms & Conditions of Services offered by SevenTwo. Acceptance of these T&C are implied and assumed upon application for services (hosting, design, or development) with SevenTwo. SevenTwo reserves the right to change these T&C at any time, with or without notice to current clients.

Payment Policies, Fees, Refunds and Terms of Agreement:
Full payment is required before any hosting service is rendered, which includes renewals. All payment-due notices will be sent by electronic mail. No bills or invoices will be sent by postal mail or fax. Billing is done on a pre-payment basis. Payment reminders will be sent 10 and 2 days prior to client’s due date. Payment is late when 10 days past due. Billing will continue until you cancel your hosting account. Any extra or duplicate payments will show as "credit" in your SevenTwo account log and can be used for any SevenTwo services. If a buyer complaint is filed against SevenTwo for any reason with Paypal, your refund eligibility will be void, and you will no longer be able to request a refund under any circumstances. You may cancel your SevenTwo account at anytime. Any account deactivated or cancelled for any reason will be charged a $75 reactivation fee. This $75 fee includes, but is not limited to, accounts cancelled due to late payment, or any violation of this T&C agreement.

30 Day Money Back Guarantee:
If an account is cancelled within 30 days of the initial signup of said account, a refund may be requested. Refunds must be requested at least 5 business days (weekdays) prior to an account reaching the 30 day period’s end. Refund requests must be sent to sales@seventwodesign.com. Refunds are only provided for web hosting plans, and will not be provided for any add-ons or domain registrations. Refunds will not be provided for any account that is cancelled for violation of any T&C. All refunds are subject to approval, and can be denied for any reason deemed appropriate by SevenTwo, the owner of SevenTwo, or any member of the SevenTwo staff.

If cancellation is done by SevenTwo due to restrictions violation, there will be no refund. SevenTwo will only allow for the discount if cancellation is not the fault of the client, as determined by SevenTwo. Additional features can be added at any time. Monthly feature prices are not prorated. SevenTwo reserves the right to change prices at any time.

Account Cancellation:
You may cancel at anytime. Phone requests will not constitute acceptance of any cancellation. To cancel your account, please contact Customer Service at sales@seventwodesign.com. Notification of cancellation must be received at least ten business days prior to your cycle date, with the cycle date being the day of the month you sign up, in order to avoid charges in full for the next cycle. It is the Clients Responsibility to secure email confirmation from SevenTwo that account has been cancelled. If the client has not yet received email confirmation of account cancellation, then the account remains active, and you will continue to be invoiced. No refunds will be given if Client has failed to ensure cancellation of account. No refunds will be given of prepaid amounts if cancellation is requested while a credit remains on the account unless cancellation falls under the 30 day money back guarantee policy.

If Client has a balance due at the time of cancellation, this balance must be paid in full. Cancellation does not absolve Client of any outstanding financial obligations.

Cancellation due to late/past/overdue balance or refusal to pay balance:
SevenTwo reserves the right to cancel Client account at any time payment is not made by 10 days past account due date. If payment is not received prior to 30 days past due date, account will automatically be assessed a $25 late fee. If account is reactivated past this 30 day period, an additional $75 reactivation fee will be assessed and a 6 month pre-payment of monthly account fee will be charged before account can be reactivated. Accounts 60 days or greater past due will be terminated with finality, any software assets remaining on SevenTwo server property seized by SevenTwo and Client’s package information deleted. Client’s billing account will remain active with all assessed fees and past due balance due. After 90 total days of non-payment, all unpaid fees and charges for release of seized assets will be sold to collection agencies, and client’s delinquency reported to credit agencies. Terminated clients accounts will not be reactivated with SevenTwo for any reason.

Indemnification Policy:
You agree to use all SevenTwo services and facilities at your own risk. We reserve the right at any time to view and transfer data to and from any server without expressed consent from the client for any reason. SevenTwo specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall SevenTwo be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold SevenTwo harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against SevenTwo, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless SevenTwo against liabilities arising out of:

(1) any injury to person or property caused by any products sold or otherwise distributed in connection with the SevenTwo servers;
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
(3) copyright infringement and
(4) any defective products sold to customer from a SevenTwo server.

SevenTwo shall be the sole arbitrator of what violates this Policy.

SPAM Policy:
SevenTwo is committed to a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either: Over the SevenTwo network, by customers or any other users of the SevenTwo network (including customers' customers); AND/OR over ANY network— if the message sent advertises or mentions a site hosted on the SevenTwo server.

We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any customer disregarding this policy. Sending unsolicited commercial email (a.k.a. "spam"), cross-posting messages to a large number of usenet groups, posting obscene or threatening messages while using or referring to a SevenTwo email address or web site URL is prohibited. The use of SevenTwo servers as a mail drop for responses to activities described above is also prohibited. Accounts cancelled due to spam will be billed a "clean up" fee of $500. Any fees levied against SevenTwo for spam activities by clients will be redirected twofold to the client in addition to termination and clean-up fees.

If you have any complaints or comments regarding Spam on our network, please direct them via email to abuse@seventwodesign.com. By agreeing to this T&C agreement, you accept full responsibility for any damage caused to SevenTwo's servers and network as a result of your account and/or any spam generated by you or your account.

Content Policy:
All services provided by SevenTwo may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any English Law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless SevenTwo from any claims resulting from the use of the service which damages the subscriber or any other party.

Adult content is allowed on SevenTwo servers.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to SevenTwo servers or any other server on the internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

• Pirated software
• Hacker programs or archives
• Warez sites
• Illegal MP3's
• Child Pornography
• Any copywritten material not belonging to the owner of the site in question

We have the right to charge fees for each item for any illegal content that you decide to upload to our servers.

Email Policy:
SevenTwo may not be the source, intermediary, or destination address involved in the transmission of any unsolicited email, email bombs, hate email, or any mass email. Your email account may not be referenced as originator, intermediary, or reply-to address of such email. We consider mass email any email message sent to more than 1000 email addresses or more than 10 news groups. Only exceptions are newsletters where you can provide proof of recipient’s voluntary agreement to join.

CGI Scripts Policy:
Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation or service to other SevenTwo customers. You will be notified 24 hours prior to removal about offending cgi script.

Chat Policy:
SevenTwo allow chat rooms. We will however not monitor these chat rooms.

Traffic Policy:
SevenTwo allows for very generous traffic, and most sites never exceed 500MB per month, unless they offer shareware, sound, video, image and multimedia archives, are mirror sites or any site whose primary purpose is file distribution. SevenTwo customers are discouraged from storing any files that cause excessive traffic on SevenTwo servers. Using your site for storage or for hotlinking of your SevenTwo files from another site is strictly forbidden. Please contact SevenTwo Technical Support team for more information. Again, 99% of the sites do not fall into this category and never reach our traffic limits.

We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any customer for any reason not prohibited by law.

Any deliberate attempt to cause damage to SevenTwo or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case

Resource Usage Policy:
If SevenTwo determines that a customer's account is utilizing an unacceptable amount of system resources, SevenTwo may temporarily deactivate the account in question. If we feel it needed, we will suspend any account using an intensive amount of resources, and give the user 10 days to either upgrade the account or move elsewhere. This only occurs in extreme cases. SevenTwo will be the sole arbiter as to what constitutes a violation of this provision. Because of the nature of this provision, each account will be considered and analyzed individually.

A NOTE ON UNLIMITED BANDWIDTH:
By the very nature of the internet and networking, this term may be misleading. For the purposes of these T&C SevenTwo defines unlimited bandwidth as unmetered bandwith within reason. Your per-second transfer rate is limited by the equipment both of the server and of your end user/browser location, and all points in between. However, your total usage of bandwidth is unmetered - the only exception being in the case of large spikes in bandwidth due to file sharing, streaming, or live media broadcasts; these will be monitored for legal reasons to ensure nothing illegal or in violation of these Terms is in progress. Consistent bandwidth "hogging", or tying up 50% or greater of the server's available per second bandwidth for an extended period of time may result in bandwidth "throttling" being placed on the offending site. Throttling is limiting the per-second transfer rate in order to free up available bandwidth for other customers. In the event that your domain(s) require 50% or greater of the available connection rate, please contact us about dedicated/shared server options.
